Terms of Service
1. Agreement
By using PropSurvival (the "Service") at propsurvival.com, you agree to these Terms. If you do not agree, do not use the Service.
2. What the Service is — and is not
The Service is analytical software: a Monte Carlo simulation engine that models probabilities from inputs you provide. It is not investment advice, trading advice, financial advice, a recommendation to purchase any evaluation, or a prediction of your results. See the Risk Disclaimer, which is part of these Terms.
3. Free tier
The free tier is provided as-is, without signup, and may be changed at any time. Free features are described on the pricing page.
4. Pro license
- Grant. One Pro purchase is a single up-front payment (not a subscription; nothing to cancel, no recurring charge) that grants you a personal, non-transferable, perpetual license to use the version(s) of the Pro features made available to you, activatable on up to 2 devices. "Perpetual" means your right to keep using the version you have does not expire and is not withdrawn if we later stop selling, maintaining, or updating the product — see Sections 10 and 11.
- Updates ("lifetime updates"). While the product remains actively maintained, your one purchase includes the firm-preset, rule-data, and feature updates we release for it, at no additional charge. Updates are provided at our discretion; "lifetime" refers to the life of the product, and we do not guarantee that any particular update, or the product itself, will be offered for any minimum or perpetual period.
- Merchant of record. Purchases are processed by Lemon Squeezy, which handles payment, tax, and invoicing.
- Refunds. 14 days from purchase, no questions asked — reply to your purchase email or contact support. Because the product is delivered digitally and runs on your device, we reserve the right to decline a refund where there is clear evidence of fraud or abuse (for example, repeated purchase-and-refund cycles).
- Fair use. Don't share, resell, or publish license keys. Keys that are leaked or abused may be deactivated. If you change or replace a device, contact support and we will normally help you move your activation.
5. Firm rule presets
Firm presets are our editorial modeling of publicly documented rules, each stamped with a verification date. Prop firms change rules without notice. The firm's own documentation is always the final authority. We are not affiliated with, endorsed by, or sponsored by any proprietary trading firm; names are used solely to identify rule sets.
6. Acceptable use
You may not misrepresent the Service's outputs as guarantees, use the Service to produce deceptive marketing (e.g., presenting simulated results as live results), or attempt to disrupt the licensing system.
7. Intellectual property
The Service's code, design, copy, and datasets are our intellectual property. Your data is yours — it stays on your device, and we claim no rights over it.
8. Warranty disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SIMULATION OUTPUTS MAY CONTAIN ERRORS OR SIMPLIFICATIONS AND ARE SENSITIVE TO YOUR INPUTS.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID FOR IT IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR TRADING LOSSES, LOST CHALLENGE FEES, LOST PROFITS, OR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
10. Service availability and changes
The Service is provided on an "as available" basis. We do not guarantee uninterrupted availability, specific uptime, particular loading speed, or ongoing compatibility with any specific browser, device, or operating system. We may add, modify, or remove features, and we may update these Terms; material changes will be dated at the top of this page, and continued use after changes constitutes acceptance. Because the core engine runs on your own device, brief interruptions to our website or the payment provider do not stop simulations you have already loaded.
11. Continuity and discontinuation
We may discontinue the Service, or any part of it, at any time. We are not obligated to operate it in perpetuity, to provide it for any minimum period, or to guarantee future updates, migration assistance, or a transition plan. We believe this is fairer than it sounds, and by design: the engine is a self-contained page that runs entirely in your browser with no dependency on our servers. A copy that is already loaded and (for Pro) activated will keep working on your device to the extent your browser and operating system continue to support it, even if we stop publishing updates or wind the Service down. What a discontinuation ends is the release of new rule verifications and features — not your ability to keep using the version you have.
An activated Pro license is deliberately built to survive our absence: once activated it is not downgraded because a validation server is unreachable, and if we ever permanently discontinue the Service, our intention is to publish a final build with the periodic license check removed, so activation cannot fail against a server that no longer exists. This paragraph is a statement of intent, not a binding guarantee — but it reflects how the product is engineered, and why your access does not depend on us still being here.
12. Assignment
You may not assign or transfer your rights under these Terms or your license without our consent. We may assign these Terms and operate, transfer, or restructure the Service — including through a sale of assets, merger, acquisition, or change of operator — provided your existing license rights are carried over on substantially the same terms.
13. Severability and entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with the Privacy Policy and Risk Disclaimer, are the entire agreement between you and us regarding the Service and supersede any prior understanding. Our failure to enforce a provision is not a waiver of it.
14. Governing law
These Terms are governed by the laws of the operator's jurisdiction of registration, without regard to conflict-of-law rules. Mandatory consumer protections of your country of residence remain unaffected.
